Mobile Homes on Rustic Land: what does the Law really say in the Valencian Community?

A few days ago, one of our clients asked us a question that we found so interesting that we thought it deserved an article of its own. So, before we begin, thank you for the suggestion!

The truth is that we are receiving more and more enquiries about mobile homes, prefabricated houses and caravans being placed on rustic land throughout the Valencian Community. Have the rules changed? Can they be installed freely? Why are we seeing so many more of them?

Let’s clear up some of the confusion.

Can I install a mobile home on rustic land in the Valencian Community?

The answer is not as straightforward as you might think.

In recent years, particularly in the Valencian Community, it has become increasingly common to see mobile homes, prefabricated houses and even caravans on rural plots of land. Rising property prices, the search for more affordable housing solutions and the speed with which these homes can be installed have made them an attractive option for many people.

However, they have also led to one of the questions we hear most often in our office:

“If it has wheels and isn’t a traditional building… can I install it without planning permission?”

The short answer is no.

The biggest myth: “It’s not a building, so I don’t need permission.”

Many people believe that a mobile home is simply a vehicle parked on private land and therefore falls outside planning regulations.

In reality, the legal position is quite different.

Valencian planning legislation requires municipal authorisation for the installation of prefabricated homes and similar structures. In fact, this requirement is expressly provided for in Valencian planning legislation (TRLOTUP). What matters is not whether the home can be moved one day, but how it is being used and how it is installed on the land.

If a mobile home is intended to be used as accommodation, even if only for weekends or holiday periods, its installation generally requires planning permission and must comply with the planning regulations applicable to the land where it is to be located. This also applies to prefabricated houses and static caravans.

What has the Spanish Supreme Court said?

This issue has even reached the Spanish Supreme Court.

The Court has made it clear that a mobile home should not be regarded simply as a trailer or vehicle merely because it retains wheels or can occasionally be moved. Its primary purpose is to provide living accommodation and, from a planning perspective, it should therefore be treated in the same way as a prefabricated house.

In other words, the fact that a home is “mobile” does not mean it can be placed on any plot of land without authorisation.

So why are we seeing so many more of them?

It’s a fair question.

Across many municipalities in the Valencian Community, there has been a noticeable increase in this type of installation. However, this does not mean that the law has changed or that there is a general permission to install mobile homes on rustic land.

Some installations have the necessary planning authorisations. Others may be in the process of being legalised. Unfortunately, others may simply not comply with planning regulations at all. Every case depends on its own particular circumstances.

So, just because you see several mobile homes in one area does not necessarily mean that anyone can do the same.

Every plot of land has its own planning classification, and each local council may require different licences, permissions or supporting documentation depending on the intended use.

Making a decision based on what a neighbour has done—or on advice found online—could result in significant planning problems, substantial fines or even demolition orders.
